Introduction to PTAB Proceedings


This introductory course provides an overview of PTAB proceedings, focusing on Inter Partes Review and Post-Grant Review proceedings. This webinar reviews filings logistics and introduces pertinent topics such as petition grounds, prior art, and claim challenges for both IPRs and PGRs. We will discuss the importance of communication between attorneys and paralegals when branding exhibits, preparing declarations and powers of attorney, serving documents, arranging payment of filing fees, and other aspects that will help filing day run as smoothly as possible. This course lays the groundwork for future modules to be released in 2023.

In 2020, I founded Virtual Patent Gateway (VPG) to provide on-demand paralegal services to Patent Trial and Appeal Board (PTAB) practitioners. My virtual services reduce clients’ overhead costs and provide them with agile staffing solutions. Since I started my company, VPG covered at least 100+ inter partes review, post-grant review and ex parte reexaminations for PTAB professionals. I am an immigrant from Hong Kong with over two decades of litigation paralegal experience, a strong work ethic, and an entrepreneurial spirit. The PTAB is an administrative body that was created only about a decade ago, so I saw the unique need for assistance in this new jurisdiction. I created VPG to fill that role.


As a minority business leader myself, I care about diversity, equity, and inclusion. That is why I have used VPG as a vehicle to increase social awareness, implementing programs that allow women and young creatives to gain experience and earn supplemental income simultaneously, even during COVID.

Jessica L.A. Marks is Senior Patent Counsel at Unified Patents, LLC. Her practice focuses on post-grant proceedings before the Patent Trial and Appeal Board (PTAB) in technology areas including the internet-of-things, cloud computing, open-source, and content distribution. Prior to joining Unified, Ms. Marks worked at Finnegan, Henderson, Farabow, Garrett & Dunner, LLP, where her practice included prosecution, litigation, ITC proceedings, and PTAB proceedings. Ms. Marks has served as an adjunct professor at George Washington Law School. Ms. Marks graduated from the University of Maryland (now Francis King Carrey) School of Law and holds a Master in Bioethics from the University of Pennsylvania School of Medicine and B.A. in Biology from the University of Pennsylvania.
